Why Claim for Cerebral Palsy?

We often speak to parents who wonder why it’s necessary to make a claim for cerebral palsy. Bringing a claim for compensation of any sort can be daunting, and at times stressful. If your child has cerebral palsy, it can be particularly challenging, as you have all the day-to-day difficulties caring for a disabled child bring to deal with as well.

Contrary to what the media would have you believe about “compensation culture” in the UK, compensation is not just handed out to anyone who asks for it and there is little evidence to support this. We strongly believe that there are many reasons why parents should claim for cerebral palsy. Here are just a few:

Prevent similar mistakes happening again

Making a claim for cerebral palsy could encourage the accountable medical agency to retrain staff in order to prevent similar mistakes being made again. This could in theory help to prevent other families having to go through the same experience.

Provide support with specialist care and assistance

At Express Solicitors we know that early intervention is key to ensuring a child with cerebral palsy gets the most out of their life. Specialist care and assistance is often essential in more complex cases of cerebral palsy but this can be costly for any family. Establishing a claim for compensation could help you and your child to remain financially secure and enable them to receive the best standard of care possible.

Uses for compensation

There are a number of ways you could use a compensation payout in order to improve your child’s quality of life, some of which include paying for:

  • Therapies (physical, occupational, behavioural therapy are often considered integral)
  • Expenses when travelling to and from medial appointments
  • Essential equipment to help with disabilities
  • Funding carers

Of course, not every instance of cerebral palsy is the result of medical negligence. Only a small minority of those affected have the condition because of the failings of the medical profession, who for the most part provide exemplary care.

However, if we can establish that things should have been done differently during the period in question (usually labour or management straight after birth) and a claim concludes successfully, you could be awarded several million pounds.

At Express Solicitors we not only help you to obtain the compensation your child deserves, but we also provide a source of support and will guide you through the legal process, step by step.
